Are The DOJ And Hunter Biden Attempting To Commit Fraud In Federal Court?

There will be no justice if the court allows the government and Hunter Biden to pretend the $1 million payment from Patrick Ho was for legal representation.

One sentence — 13 words — out of the thousands spoken last Wednesday over the course of the three hours that federal prosecutors, defense attorneys, Hunter Biden, and Judge Maryellen Noreika discussed the president’s son’s plea agreement suggests the Department of Justice and Hunter Biden are attempting to commit fraud on a federal court.

On Wednesday, Hunter Biden appeared before a federal court in Delaware prepared to enter a guilty plea on two misdemeanor tax counts. The hearing, however, did not go as planned when Judge Noreika, rather than rubberstamping the sweetheart deal the Biden administration had entered into with the president’s son, quizzed the attorneys and Hunter Biden on the terms of the agreement and their respective understanding of the government’s promise not to further prosecute Hunter.

When Noreika questioned Hunter Biden about the $1 million Patrick Ho paid Owasco LLC on March 22, 2018, purportedly for legal representation, the president’s son was cornered. With the government and the defendant both telling the court that money represented fees for legal services, Hunter Biden had to explain how: “I think Owasco PC acted as a law firm entity, yeah.” That’s how Hunter replied initially, but then immediately equivocated: “I believe that’s the case, but I don’t know that for a fact.”

Hunter’s hedge was a tell that what he had just told the court was not the truth. But it was imperative that the president’s son caveat his prior statement that his law firm entity was retained to provide legal services for Ho because the judge had made clear that Hunter Biden was under oath and that “any false answers may be used against [him] in a separate prosecution for perjury.”

While Hunter’s backtracking may have saved his backside from a perjury conviction, it may well blow up his plea deal because it highlighted that the “Statement of Facts” the government incorporated into the plea agreement contained a near-certain false representation: that the $1 million Patrick Ho transferred to Hunter Biden was “payment for legal fees.”
Statement of Facts?

While the government did not file the plea agreement or the exhibits incorporated into that deal on the public docket, during last week’s hearing the prosecutor and the court read excerpts on the record. Among other things, in the plea agreement, Hunter Biden “admits to the information contained in the Statement of Facts,” which was attached as Exhibit 1. Hunter Biden’s sweetheart plea deal blew up epically. That now leaves everything on the table in terms of charges, as well as looking into Joe Biden’s connections to the scandal. We saw that on Monday as the House Oversight Committee interviewed Hunter Biden’s former partner Devon Archer. Archer confirmed Joe Biden was talking on the speakerphone into meetings, and that was the “big guy.” He also revealed information about another Chinese connection and the bizarre comment Hunter made about the Biden name and “handsome Aryan godlike men.” We will likely find out more about what he said, particularly when the transcript is released.

But now there’s new information that Hunter may have gotten himself in trouble again with what he told the judge during his plea hearing. During the hearing, Judge Maryellen Noreika asked Hunter about being a member of the bar.

“You’re member of the bar?” she asked.

“Yes, your Honor,” he replied. “District of Columbia and Connecticut, your Honor.”

Hunter Biden was admitted to the bar in Connecticut in 1997.

However, records show he’s been suspended in Connecticut for more than two years. A Judicial Branch spokesperson confirmed he was “not in good standing” and had an administrative suspension.

This was uncovered by Kevin Rennie, a Connecticut lawyer and former state legislator, who reported on it in his blog.

Rennie said Hunter should have known better, and he termed it misleading the judge.-- excerpt, rest at link above --

Andrew McCarthy Exposes the Real Reason for Hunter Biden's Sweetheart Plea Deal

With David Weiss' promotion to special counsel, the future of the Hunter Biden probe appears unclear. Charges have been officially dropped in Delaware as part of a stated plan to charge the president's son in another jurisdiction.

That begs the question of why the charges were ever in Delaware in the first place if they supposedly don't belong there now. If it feels like the DOJ is hoping to draw a less-skeptical judge to rubber stamp yet another sweetheart plea deal, that's probably because that's what appears to be happening. A recent leak revealed that while the FBI believes it has evidence to charge Hunter Biden with FARA revelations (and the publicly known evidence is stunning), the special counsel isn't really interested in pursuing that path.

From the moment news broke that Hunter Biden was being charged with two misdemeanors for not paying his taxes (and being given pre-trial diversion for a gun charge that normally demands prison time), it has seemed as if the DOJ was more interested in representing the president's son than actually prosecuting him to the full extent of the law.

There may be even more to it, though and his latest piece, Andrew McCarthy exposes what he believes is the real reason for the sweetheart plea deal.

Sham special counsel David Weiss could not have more royally screwed up the Hunter Biden case. But of course, if that was the plan, it’s not really a screwup, right?

After his opening, McCarthy takes the time to lay out how things arrived at their present position, including the fact that Judge Aileen Noreika was skeptical of the legality of burying broad immunity in a diversion agreement. Never mind that the diversion agreement went against DOJ protocol anyway, which demands the pursuit of incarceration for the gun crime Hunter Biden committed. -- excerpt, rest at link above --
