An attorney for first son Hunter Biden spurned House Oversight Committee Chairman James Comer's (R-KY) record request, insisting it violates Supreme Court precedent.
Comer's office sent letters to James Biden, Hunter Biden, and Hunter's former business partner Eric Schwerin demanding records pertaining to overseas dealings with Chinese intelligence-linked businessmen. Hunter Biden's lawyer, Abbe David Lowell, argued that as a private citizen, the panel faces "especially restricted investigative power."
HUNTER BIDEN: POSSIBLE FOOTRACE BETWEEN GOP AND DOJ TO INVESTIGATE FIRST SON
"While your Letter attempts to demonstrate 'legislative purpose' for investigating Mr. Biden, it fails nevertheless to address that the Committee's scope of oversight is limited when dealing with private persons like our client," Lowell wrote in a response letter.
He cited Supreme Court precedent that ruled "when an inquiry relates to a president, Congress must 'adequately identify its aims and explain why the president's information will advance its consideration of possible legislation.'"
"Whether you think Mr. Biden acted properly or not, and whether you think his private business dealings and associations are inappropriate or not, his behavior is that of a private citizen, not a public official," Lowell added. -- excerpt, rest at link above --
