In response to this, Lake says that she will file an appeal to the decision.

According to Axios, “In his ruling, Thompson acknowledged “the anger and frustration of voters” but said the court “cannot accept speculation or conjecture in place of clear and convincing evidence.”

Legal Experts Weigh In on the Merits of Kari Lake’s Election Lawsuit

As the second day of Kari Lake’s trial contesting Arizona’s gubernatorial election wrapped up Thursday, various election law attorneys provided their analysis on social media and videos. Some were optimistic that Maricopa County Superior Court Judge Peter Thompson would grant Lake relief, declaring her the winner or calling for a new election, but some were not as optimistic.

Robert Gouveia, an attorney in Scottsdale with his own legal podcast, provided a recap where he expressed his concern about the trial.

“What makes this case so difficult for Kari Lake, is it’s her burden to prove it,” he said. “They don’t have to negate anything. They just say ‘we did our job.’”

Gouveia cited the judge’s previous minute entry allowing the case to proceed based on the printer problems. Thompson said that Lake could present her case based on A.R.S. 16-672(A)(1), challenging an election “For misconduct on the part of election boards or any members thereof in any of the counties of the state, or on the part of any officer making or participating in a canvass for a state election.”

The judge said Lake would need to show for count two illegal tabulator configurations, 1) the “malfeasant person,” 2) the printer malfunction caused lost votes for the candidate, and 3) those votes would have affected the election. Count four was ballot chain of custody.

Gouveia then went over whether Lake’s attorneys were able to show those three elements. He said voter suppression alone should have been actionable for the court, but the judge wanted those three actions proven.

Richard Baris, director of Big Data Poll, testified on Thursday. Gouveia said that his testimony was significant for pointing out that 20 percent of people who told him they would conduct an exit poll with him didn’t. Also, Gouveia said it was evident they weren’t able to vote.

“This is important testimony because we’re trying to close that gap, we’re trying to change the course of the election, it’s gotta change the outcome,” he said. “And, they’re trying to quantify this number, using data, and this guy’s got a lot of it.”

Gouveia expressed his concern that while it can be measured who checked in and then gave up trying to vote due to the wait, “what about the people who just drive by the tabulation center and see a line out the door for two hours, how do you quantify it?” Gouveia said this constituted voter suppression.

Gouveia said Baris’ conclusion was essential for Lake’s case.

“In my professional opinion, and some of this is not opinion, we know the vote totals in these areas that we’re talking about and what the margins were, it definitely impacted the outcome, the only question for me is whether it had the potential to change the results, and in my professional opinion I believe it was enough to change the leaderboard. … And the number was substantial enough to change who the winner was,” he said.

“Boom! That’s what they needed,” Gouveia added. “That’s that ‘meaty statement’ right there. They can point to an expert and say, ‘Look, judge, It would be significant enough to change the leader of the race. You went back, and you’re under advisement, and you said ‘we gotta check this box, and this box, we gotta check that box. And they’re saying boom! Kari Lake Will Appeal After Judge Rejects Election Lawsuit

Republican Kari Lake will file an appeal after a judge rejected her claims in a lawsuit that sought to overturn her election loss in the Arizona gubernatorial race to Democrat Katie Hobbs by around 17,000 votes.

“Maricopa County Superior Court Judge Peter Thompson issued a decision in the suit at 10:45 a.m. on Christmas Eve, shooting down all of Lake’s claims. His decision came after a two-day trial on Wednesday and Thursday in which Lake’s team attempted to convince him that a Maricopa County employee had intentionally tampered with Election Day ballot printers in an effort to disenfranchise Republican voters and that the county’s failure to adhere to chain-of custody rules for early ballots dropped off on Election Day led to thousands of illegal ballots being injected into the system,” Arizona Mirror reported.

Lake tweeted Saturday morning: “This Judge did not rule in our favor. However, for the sake of restoring faith and honesty in our elections, I will appeal his ruling.”

Judge Thompson wrote in his decision: “Every one of Plaintiff’s witnesses — and for that matter, Defendants’ witnesses as well — was asked about any personal knowledge of both intentional misconduct and intentional misconduct directed to impact the 2022 General Election. Every single witness before the Court disclaimed any personal knowledge of such misconduct. The Court cannot accept speculation or conjecture in place of clear and convincing evidence.”

Over 200 people submitted statements to the court detailing their frustrating experiences trying to vote on Election Day in Maricopa County. However, Judge Thompson stated that many of those voters were still able to cast their ballots.

“This Court acknowledges the anger and frustration of voters who were subjected to inconvenience and confusion at voter centers as technical problems arose during the 2022 General Election,” Thompson wrote.

Lake relied on witnesses like cybersecurity expert Clay Parikh, who testified that issues with ballot-on-demand printers on Election Day were caused by a 19-inch ballot image being printed onto 20-inch paper. He opined that it was done intentionally and could not have happened by accident.

Maricopa County Co-Elections Director Scott Jarrett later explained that the smaller printing size happened after other printer problems had already cropped up on Election Day, when techs changed the settings to “fit to print” while they were troubleshooting. Jarrett said it only happened at three voting centers and impacted 1,300 ballots, though Parikh claimed that he found the missized ballots in batches he inspected from six voting centers.

Attorney Files Lawsuit Against Judge Who Dismissed Kari Lake’s Election Contest

Ryan Heath, an attorney who started The Gavel Project to engage in lawfare against woke ideology, has filed suit against the judge who dismissed Kari Lake’s election lawsuit. Submitted on Monday, the writ of mandamus demands that Maricopa County Superior Court Judge Peter Thompson vacate his ruling and award the election to Lake.

Heath told The Arizona Sun Times he doesn’t really know where Thompson came up with the high bar he required Lake’s attorneys to prove in order to overturn the election. Thompson required showing by clear and convincing evidence that the misconduct was intentional and meant to change the election, was performed by one of the appropriate people in charge, and that it changed the election.

Heath said this was the wrong standard. He added the judge should have relied on Reyes v. Cuming, a 1997 Arizona case involving similar circumstances, where signatures on the envelopes were not compared to the voter registration list, which violated a non-technical statute.

Heath’s writ of mandamus, which is a type of lawsuit seeking to order a public official to do their job, focused on the problems with signature verification. He reviewed the minimal amount of time signature verification workers were given to compare signatures on each ballot envelope with the signatures in the system. He argued that “it was physically and mathematically impossible for them to have engaged in the statutorily mandated task of verifying signatures.”

He said it would take 30 seconds to verify a signature, but the signatures were verified at a rate of one in less than a second — 0.975 seconds.

He declared, “[I]t is physically impossible for human beings to pull off any meaningful comparison with any reasonable accuracy.”

Heath included testimony from signature verification workers who reported rejection rates in the 25 to 40 percent range. One of those workers reported that instead of curing those mismatched signatures as required by A.R.S. 16-550(A), about 90 percent of them were approved anyway. Reviewers were allowed to put stickers on ballots showing they were approved with no oversight; there was no record of who placed the sticker on them.-- excerpt, rest at link above --

Testimony to Arizona Senate Election Committee Reveals Thousands of Misdemeanors Allegedly Committed by Maricopa County in 2022 Election

The Arizona Senate’s Election Committee continued the second part of a hearing on Monday that began last week, featuring testimony from election integrity proponents. Shelby Busch, the co-founder of We the People AZ, and Heather Honey of Verify Vote, went over five areas where their team found apparent law violations by Maricopa County in the 2022 election.

Busch said during her presentation, “We want safe elections, not convenient ones,” sparking applause from the audience. State Senator Wendy Rogers (R-Flagstaff), the committee chair, kept a tight rein over the proceedings, often calling out the Democratic senators on the committee when they were out of line. One used the phrase “election denier,” and Rogers told her it was inappropriate.

Busch explained that her team found many violations of the state’s Election Procedures Manual (EPM), which are class 2 misdemeanors. The statute that addresses the EPM, A.R.S. 16-452(C), states that “A person who violates any rule adopted pursuant to this section is guilty of a class 2 misdemeanor.”

Busch’s team submitted public records requests to Maricopa County to investigate the 2020 and 2022 elections. Although the county turned over some of the data, there was a significant amount that it refused to or heavily redacted, which Busch is now fighting legally. One of the county’s excuses was it had misplaced the data.

Busch said she found election law violations in five categories. They were:

adjudication of ballots, cast ballots that didn’t match;
over 8,000 people who were unable to vote on Election Day;
a backdoor portal to voter registration records that nonprofits were able to access; and
around 300,000 ballots submitted to drop boxes that lacked a chain of custody

For adjudication, Busch said her team found that the rate went up sharply in the 2020 election and then the 2022 election. Normally, she said no more than four percent of ballots require adjudication, which means there was something incorrect with the ballot, such as an overvote or missing some information, so they go to a bipartisan board that reviews them. But in 2020, that percentage jumped up to 11.9 percent. In 2022, it increased to 14.36 percent.

She expressed her concern that Maricopa County redacted the Cast Vote Record (CVR) before providing it to her team, impeding the transparency of the election. She said the CVR provides the final breakdown of the ballots cast, broken down by the candidates and individual ballots.

Next, Busch discussed discrepancies between the number of ballots listed in the system log files and the number of ballots in the CVR. The system log files track every ballot fed into the tabulator, and can provide one of six error codes when they aren’t accepted, she said. There were 15 batches of ballots, around 10,000 total, that were logged but did not make it into the final CVR, she reported.
